A Critique of Adjudication : fin de siecle - Thryft

A major statement from one of the foremost legal theorists of our day, this book offers a penetrating look into the political nature of legal, and especially judicial, decision making. It is also the first sustained attempt to integrate the American approach to law, an uneasy balance of deep commitment and intense skepticism, with the Continental tradition in social theory, philosophy, and psychology. At the center of this work is the question of how politics affects judicial activity-and how, in turn, lawmaking by judges affects American politics. Duncan Kennedy considers opposing views about whether law is political in character and, if so, how. He puts forward an original, distinctive, and remarkably lucid theory of adjudication that includes accounts of both judicial rhetoric and the experience of judging. With an eye to the current state of theory, legal or otherwise, he also includes a provocative discussion of postmodernism.Ultimately concerned with the practical consequences of ideas about the law, A Critique of Adjudication explores the aspects and implications of adjudication as few books have in this century. As a comprehensive and powerfully argued statement of a critical position in modern American legal thought, it will be essential to any balanced picture of the legal, political, and cultural life of our nation.
This book develops an original theory of group and organizational behavior that cuts across disciplinary lines and illustrates the theory with empirical and historical studies of particular organizations. Applying economic analysis to the subjects of the political scientist, sociologist, and economist, Mancur Olson examines the extent to which the individuals that share a common interest find it in their individual interest to bear the costs of the organizational effort. The theory shows that most organizations produce what the economist calls “public goods”―goods or services that are available to every member, whether or not he has borne any of the costs of providing them. Economists have long understood that defense, law, and order were public goods that could not be marketed to individuals, and that taxation was necessary. They have not, however, taken account of the fact that private as well as governmental organizations produce public goods. The services the labor union provides for the worker it represents, or the benefits a lobby obtains for the group it represents, are public they automatically go to every individual in the group, whether or not he helped bear the costs. It follows that, just as governments require compulsory taxation, many large private organizations require special (and sometimes coercive) devices to obtain the resources they need. This is not true of smaller organizations for, as this book shows, small and large organizations support themselves in entirely different ways. The theory indicates that, though small groups can act to further their interest much more easily than large ones, they will tend to devote too few resources to the satisfaction of their common interests, and that there is a surprising tendency for the “lesser” members of the small group to exploit the “greater” members by making them bear a disproportionate share of the burden of any group action. All of the theory in the book is in Chapter 1; the remaining chapters contain empirical and historical evidence of the theory’s relevance to labor unions, pressure groups, corporations, and Marxian class action.

Since long before computers were even thought of, data has been collected and organized by diverse cultures across the world. Once access to the Internet became a reality for large swathes of the world's population, the amount of data generated each day became huge, and continues to grow exponentially. It includes all our uploaded documents, video, and photos, all our social media traffic, our online shopping, even the GPS data from our cars."Big Data" represents a qualitative change, not simply a quantitative one. The term refers both to the new technologies involved, and to the way it can be used by business and government. Dawn E. Holmes uses a variety of case studies to explain how data is stored, analyzed, and exploited by a variety of bodies from big companies to organizations concerned with disease control. Big data is transforming the way businesses operate, and the way medical research can be carried out. At the same time, it raises important ethical issues; Holmes discusses cases such as the Snowden affair, data security, and domestic smart devices which can be hijacked by hackers.ABOUT THE SERIES: The Very Short Introductions series from Oxford University Press contains hundreds of titles in almost every subject area. The Poems of Exile : Tristia and the Black Sea Letters - Thryft

In the year A.D. 8, Emperor Augustus sentenced the elegant, brilliant, and sophisticated Roman poet Ovid to exile—permanently, as it turned out—at Tomis, modern Constantza, on the Romanian coast of the Black Sea. The real reason for the emperor's action has never come to light, and all of Ovid's subsequent efforts to secure either a reprieve or, at the very least, a transfer to a less dangerous place of exile failed. Two millennia later, the agonized, witty, vivid, nostalgic, and often slyly malicious poems he wrote at Tomis remain as fresh as the day they were written, a testament for exiles everywhere, in all ages. The two books of the Poems of Exile, the Lamentations (Tristia) and the Black Sea Letters (Epistulae ex Ponto), chronicle Ovid's impressions of Tomis—its appalling winters, bleak terrain, and sporadic raids by barbarous nomads—as well as his aching memories and ongoing appeals to his friends and his patient wife to intercede on his behalf. While pretending to have lost his old literary skills and even to be forgetting his Latin, in the Poems of Exile Ovid in fact displays all his virtuoso poetic talent, now concentrated on one objective: ending the exile. But his rhetorical message falls on obdurately deaf ears, and his appeals slowly lose hope. A superb literary artist to the end, Ovid offers an authentic, unforgettable panorama of the death-in-life he endured at Tomis.

Achieving prevalence as an ideology in the political and social ferment of late 18th-century Europe and America, nationalism first found expression during the course of such historical upheavals as the American and French Revolutions. Its founders and early sponsors--Rousseau, Herder, Fichte, Korais, and Mazzini--looked to nationalism as the manifestation of modern humanity's most essential aspirations: autonomy, unity, identity. Born of notions regarding popular freedom and sovereignty that had been gathering momentum for generations, it conjured up images of a modernizing West at once hungry for change and yearning for a return to age-old concepts of fraternity and ancient heritage. Since that time nationalism, having taken on countless different dimensions, remains a vital and dynamic force for change--whether for good or otherwise.Despite only recently becoming the subject of scholarly debate, nationalism has been the focus of a truly prodigious amount of writing. This important Oxford Reader makes the topic more accessible by offering a broad, authoritative treatment of the key contributions to the subject, while giving unprecedented depth to recent debates and issues. Edited by two of the field's most influential scholars, the readings are representative of the vast array of experience and scholarship that have shaped the concept of nationalism for over two centuries. From Ernest Renan's What is a Nation?, written in the 1880s, to the more current views of the 1990s, Nationalism gathers under one cover an impressive array of writing on everything from imagined communities to ethno-regional movements. In no other volume will students of politics, history, sociology, anthropology, international relations, and cultural studies have access to such a definitive appraisal of one of the modern world's most influential--and explosive--ideas.
Notturno - Thryft

Composed during a period of extended bed rest, Gabriele D'Annunzio's Notturno is a moving prose poem in which imagination, experience, and remembrance intertwine. The somber atmosphere of the poem reflects the circumstances of its creation. With his vision threatened and his eyes completely bandaged, D'Annunzio suffered months of near-total blindness and pain-wracked infirmity in 1921, and yet he managed to write on small strips of paper, each wide enough for a single line. When the poet eventually regained his sight, he put together these strips to create the lyrical and innovative Notturno. In Notturno D'Annunzio forges an original prose that merges aspects of formal poetry and autobiographical narrative. He fuses the darkness and penumbra of the present with the immediate past, haunted by war memories, death, and mourning, and also with the more distant past, revolving mainly around his mother and childhood. In this remarkable translation of the work, Stephen Sartarelli preserves the antiquated style of D'Annunzio's poetic prose and the tension of his rich and difficult harmonies, bringing to contemporary readers the full texture and complexity of a creation forged out of darkness.

The Rise of the West, winner of the National Book Award for history in 1964, is famous for its ambitious scope and intellectual rigor. In it, McNeill challenges the Spengler-Toynbee view that a number of separate civilizations pursued essentially independent careers, and argues instead that human cultures interacted at every stage of their history. The author suggests that from the Neolithic beginnings of grain agriculture to the present major social changes in all parts of the world were triggered by new or newly important foreign stimuli, and he presents a persuasive narrative of world history to support this claim. In a retrospective essay titled "The Rise of the West after Twenty-five Years," McNeill shows how his book was shaped by the time and place in which it was written (1954-63). He discusses how historiography subsequently developed and suggests how his portrait of the world's past in The Rise of the West should be revised to reflect these changes. "This is not only the most learned and the most intelligent, it is also the most stimulating and fascinating book that has ever set out to recount and explain the whole history of mankind. . . . To read it is a great experience. It leaves echoes to reverberate, and seeds to germinate in the mind."—H. R. Trevor-Roper, New York Times Book Review

Supplementing close textual analysis with material drawn from Bely's theoretical and autobiographical writings, Alexandrov traces in detail how this conception evolved from four early experimental prose narratives to the major novels, and how it is manifested in their themes, form, and style. Alexandrov also provides lucid discussions of the significant influence that several philosophical and occult systems had on Bely's art, and of the theoretical problem of what constitutes a Symbolist novel.

Since its publication almost 150 years ago, The Idea of a University has had an extraordinary influence on the shaping and goals of higher education. The issues that John Henry Newman raised―the place of religion and moral values in the university setting, the competing claims of liberal and professional education, the character of the academic community, the cultural role of literature, the relation of religion and science―have provoked discussion from Newman's time to our own. This edition of The Idea of a University includes the full text of "University Teaching" and four selections from "University Subjects," together with five essays by leading scholars that explore the background and the present day relevance of Newman's themes. In the essays Martha Garland discusses the character and organization of the early nineteenth-century English universities upon which Newman based much of his vision; Frank M. Turner traces the impact of Newman's influence during the vast expansion of higher education since World War II; George Marsden investigates how the decreasing emphasis on religion has affected higher education; Sara Castro Klaren examines the implications of Newman's views on education and literature for current debates between proponents of a curriculum based on western civilization and one based on multiculturalism; and George Landow considers what the advent of electronic communication will mean to university teaching, research, and community. To aid accessibility, the edition also includes an analytical table of contents, a chronology and biographical sketch of Newman's life, questions for discussion, expanded notes, and a glossary of names, all of which will help make this the standard teaching text for Newman's work.

How was magic practised in medieval times? How did it relate to the diverse beliefs and practices that characterised this fascinating period? In Magic in the Middle Ages Richard Kieckhefer surveys the growth and development of magic in medieval times. He examines its relation to religion, science, philosophy, art, literature and politics before introducing us to the different types of magic that were used, the kinds of people who practised magic and the reasoning behind their beliefs. In addition, he shows how magic served as a point of contact between the popular and elite classes, how the reality of magical beliefs is reflected in the fiction of medieval literature and how the persecution of magic and witchcraft led to changes in the law. This book places magic at the crossroads of medieval culture, shedding light on many other aspects of life in the Middle Ages.

Marjorie Perloff, among our foremost critics of twentieth-century poetry, argues that Ludwig Wittgenstein provided writers with a radical new aesthetic, a key to recognizing the inescapable strangeness of ordinary language. Taking seriously Wittgenstein's remark that "philosophy ought really to be written only as a form of poetry," Perloff begins by discussing Wittgenstein the "poet." What we learn is that the poetics of everyday life is anything but banal."This book has the lucidity and the intelligence we have come to expect from Marjorie Perloff.—Linda Munk, American Literature"[Perloff] has brilliantly adapted Wittgenstein's conception of meaning and use to an analysis of contemporary language poetry."—Linda Voris, Boston Review"Wittgenstein's Ladder offers significant insights into the current state of poetry, literature, and literary study. Perloff emphasizes the vitality of reading and thinking about poetry, and the absolute necessity of pushing against the boundaries that define and limit our worlds."—David Clippinger, Chicago Review"Majorie Perloff has done more to illuminate our understanding of twentieth century poetic language than perhaps any other critic. . . . Entertaining, witty, and above all highly original."—Willard Bohn, Sub-Stance
